Terms & CONDITIONS

 

Booking Process and Contractual Agreement

After paying your deposit for a tour, clinic, shuttle or rental, you are entering a binding contract with Dirt Gypsy Adventures. This booking contract is initiated when a written confirmation (email) is sent to you upon receipt of your deposit and is effective on the date snd time of the time stamp when the email was sent.  If you do not receive a confirmation email, please contact us immediately via phone or email. You must be at least 18 years old to make a booking or reservation and agree that you will furnish complete and accurate information and details to Dirt Gypsy Adventures.

 

Cancellation Policy

We understand that the unexpected sometimes rears its ugly head and that life sometimes gets in the way of that perfect vacation you’ve got planned. While we try our best to be understanding and accommodate cancellations, Dirt Gypsy Adventures adheres to the following cancellation policy (private and custom tours may be handled differently – consult your individualized trip materials for these terms):

Scheduled Multi-Day Tours

No Worry Window: After paying your initial deposit, you have 10 days to cancel and get a 100% refund. This serves as ample time to get your flights, travel plans and work leave in order without having to stress about another rider taking your place on a trip with limited availability. After 10 days, the following applies:

  • 10 days after booking up to 90 days before trip start: Full refund, minus a processing fee of $250 per person

  • 60 - 89 days before trip start: 50% refund, minus a processing fee of $250 per person

  • Cancellations made less than 60 days before trip start will not receive a refund

Scheduled One-Day Tours

We extend a 48-hour cancellation policy on our guided day tours (half and full day). If you need to cancel within 48-hours of the listed start time, no refunds will be issued. Cancellations made more than 48 hours before departure will be eligible for a full refund or credit for future use.

Scheduled Clinics

  • 30+ days before clinic start date: 100% of clinic price as refund or future clinic credit, minus $25 cancellation fee per person

  • 72 hours– 29 days before clinic start date: 50% of clinic price as refund or future clinic credit, minus $25 cancellation fee per person

  • Cancellations made less than 72 hours before clinic start date will not receive a refund

Scheduled Trailhead Shuttles

We extend a 48-hour cancellation policy on our trailhead shuttles. Cancellations made at least 48 hours before departure date will be issued a 100% refund. Cancellations made between 24-48 hours will be issued a 100% credit for future use. Cancellations made with less than 24-hours of your departure will forfeit the entire amount and no credits or refunds will be issued.

Private Trailhead Shuttles

If you need to reschedule dates or times for your shuttle(s), please contact our office via phone. We will do our best to accommodate your request without penalty if made more than 30 days from your departure. If you need to cancel your shuttle(s), there is a non-refundable 25% fee of the total amount if the cancellation request is made more than 30 days before departure. Cancellations made 0-30 days before departure will not be refunded. We are not responsible for factors outside of our control, such as weather, air quality, wildfires, acts of terror, public health crises, or other environmental hurdles that may impact your needs for our services. Dirt Gypsy Adventures will do its best to assist our customers in the event that you need to reschedule due to said factors. Cancellation of trailhead shuttles due to the above factors are not eligible for refunds, however we will offer our customers credit for future use.

Dirt Gypsy Adventures reserves the right to cancel any of our tours for any reason and at any time. While this instance is highly unlikely, all payments made by guests will be refunded promptly.

 

If a tour is cancelled, Dirt Gypsy Adventures carries no responsibility for guest’s personal expenses, including hotel arrangements and airfare. Contact our staff to confirm your tour details before making your finalized travel arrangements.

Medical & Travel Insurance

We strongly recommend purchasing travel insurance and have medical insurance in place to protect you from financial loss during your trip. Accidents, injuries, flight delays, cancellations from vendors, and a variety of other unexpected hurdles can happen.

​

Having travel interruption insurance and travel medical & evacuation insurance are personal decisions, but we cannot stress the importance of heavily considering these before attending your tour. If you do elect to purchase  medical coverage, do so shortly after paying your trip deposit.Travel medical insurance provides coverage for personal accident, including broken bones, dismemberment, death, emergency remote evacuation including helicopter evacuation, medical expenses and emergency repatriation. If you purchase medical and evacuation insurance you must provide policy details to our office before your trip departure date via email. Travel interruption insurance typically must be secured within 2 weeks of paying your tour deposit and you will be asked for proof of insurance before trip start. If you choose to travel without adequate insurance coverage, Dirt Gypsy Adventures will not be liable for any losses howsoever arising, in respect to insurance coverage that would have otherwise have been available.

Pre-Trip Information

You will be emailed material specific to your tour, clinic, shuttle or rental after paying your deposit. It is your responsibility to review all of the information contained within. You must also update your personal information, travel documents and travel insurance details as soon as possible if these details change after completing the rider questionnaire. It is your responsibility to contact us if any information is incorrect or if you have any questions. We cannot accept liability or responsibility if you do not notify us of any inaccuracies. If you fail to submit your travel documents, personal details and other necessary documentation prior to departure, we reserve the right to treat your booking as cancelled by you and impose the cancellation fees described in this agreement.

Waivers & Liability Releases:

All participants joining a Dirt Gypsy Adventures tour, clinic or utilizing equipment owned by Dirt Gypsy Adventures are required to read, understand and sign a Release of Liability, Waiver of Claims, Assumption of Risks and Indemnity Agreement electronically during the registration process. This document cannot be amended prior to signing. Following registration for a trip, clinic or rental, we will send you a link to complete the necessary waiver(s). If you would like to review the waiver prior to booking, contact our office and we can furnish you with a copy of it

 

Trip Pricing & Accepted Payment Methods

Prices for specific tours, clinics, shuttles and tours are listed on the site and state the specific inclusions and exclusions. All prices are listed in US dollars. All multi-day tour prices and based on double occupancy. Single supplement pricing is available upon request as it is dependent on the travel dates and destinations. All prices listed include sales tax, so what you see is what you pay. Rental bikes are subject sales tax, which is collected during checkout.

Dirt Gypsy Adventures accepts payments made by check, credit card (Visa, Master Card, American Express & Discover), wire transfer or cash. All payments must be made in US dollars.

Tour Changes - Dates & Destinations

We encourage you to call us to discuss your travel plans and desires prior to making a booking. This allows us a chance to listen to you and recommend destinations and tours that are suited for your personal interests, abilities, and travel dates. If you need to change your dates of travel and there is space available on another tour, we will accommodate the request. Please note that additional costs may be required if the tour you are joining is more expensive. Additionally, if the tour you change to is less expensive, no refund will be given. For date and destination changes made over 60 days from the start of a trip, no fee is charged. Changes made within 60 days of departure are subject to a $125 fee.

Reservations & Book Now Policy

Reservations for Dirt Gypsy Adventures’ tours can be made by calling us at 844-464-9779. General questions regarding our tours and destinations can also be directed to info@dirtgypsyadventures.com. We offer the ability to reserve a space on any of our tours by clicking the ‘Reserve Your Spot ’ tab, where you can fill out a request form. One of our team members will contact you shortly thereafter to proceed with finalizing the booking and to collect a deposit. Filling out the form and submitting it DOES NOT guarantee your reservation. Your space on a tour will be held for 48 hours. If we are unable to contact you within the 48-hour window, you will forfeit your reservation (at no penalty), so please be sure to double check your contact information before clicking ‘submit’.

We ask that clients do not book flights without first consulting with our office. Each trip is confirmed to run, when we have a minimum of four participants booked. All travel documents, flight details, and personal information, and any required trip add-ons must be paid for and submitted to our office prior to 60 days before the start of the trip. If you’re unable to have this information to us and your balance paid to us by 60 days – advise our office of your plans. We’ll do our best to accommodate last-minute requests, but within 60 days of the ride departure, we cannot guarantee we can deliver the advertised itinerary.

Changes to Itinerary

Dirt Gypsy Adventures holds the right to modify any of our itineraries without notice to our guests. Weather (and other acts of God), regional events, lodging availability, and group sizes can drastically effect our operations. In striving to offer the best experience, revisions to our tours may be made leading up to departure date and include (but are not limited to) routes, hotels, and restaurants. Please note that we are committed to offering the best experience possible and will enact as few changes as deemed necessary to ensure this is achieved.

Children on Tour

Dirt Gypsy Adventures happily offers our scheduled multi-day tours to any guest aged 15 and over. Please take the ability of your children into account when selecting your tour. We are more flexible with this age requirement with our one day tours and can often times cater to younger individuals. Call to discuss before booking. For children that are 14 and younger, we suggest you contact our office to discuss options that are best suited for these young riders. We may recommend a private or custom tour designed to cater to the age & skill level of your children, your travel dates, and group size to maximize value, safety, and an overall incredible experience.

Assisted Travel Planning

With an intimate and in-depth knowledge of the regions we operate tours in, Dirt Gypsy Adventures is proud to serve as a viable resource to our guests when arranging travel to/from one of our adventures. We’re happy to spend some time with you recommending hotel, airline, dining, and transportation options, but we assume no responsibility in errors or complications that arise from arrangements made external to our tours.

Permitting

Our tours are operated with special use permits granted by the land management agencies and governing bodies that regulate and govern the trails, forests, parks and recreational areas that our operations take place within. Permitting from the US Forest Service, BLM, and other agencies may impose limits as to how many guests we can have on a given tour; therefore you may see the maximum guest cap vary from one tour to the next. Preliminary itineraries may exist on our website for tours where special use permitting is undergoing review and not yet secured – the itinerary listed in these instances will undergo slight modifications to ensure our operations abide by the legal requirements as a commercial tour operator.

Limitations of Liability

Please refer to your liability release for a full description of Dirt Gypsy Adventures limitations of liability. Dirt Gypsy Adventures is not responsible for bodily injury, illness, death or property damage that results from participation in any of our tours. Mountain biking is often times a physically demanding sport with inherent risks related to terrain, skill, fitness, experience, and weather conditions. 

 

Terms of Use

1. Terms

By accessing this web site, you are agreeing to be bound by these web site Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance, with any applicable local lows. If you do not agree with any of these terns, you are prohibited from using or accessing this site. The materials contained in this web site are protected by applicable copyright and trademark law.

 

2. Use License

a.     Permission is granted to temporarily download one copy of the materials (information or software) on Dirt Gypsy Adventures’ web site for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

i.      modify of copy the materials;

ii.     use the materials for any commercial purpose, or for any public display (commercial or non-commercial)

iii.   attempt to decompile or reverse engineer any software contained on Dirt Gypsy Adventure’s web site.

iv.   remove any copyright or other proprietary notations for the materials; or

v.    transfer the materials to another person or ‘mirror’ the materials on any other server.

vi.   This license shall automatically terminate if you violate any of these restrictions and may be terminated by Dirt Gypsy Adventures at any time. Dirt Gypsy Adventures makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Dirt Gypsy Adventures does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet web site or otherwise relating to such materials or on any sites linked to this site.

 

4. Limitations

In no event hall Dirt Gypsy Adventures or its suppliers or vendors be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on Dirt Gypsy Adventures’ Internet site, even if Dirt Gypsy Adventures or a Dirt Gypsy Adventures authorized representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

 

5. Revisions and Errata

The materials appearing on Dirt Gypsy Adventures’ web site could include technical, typographical, or photographic errors. Dirt Gypsy Adventures does not warrant that any of the materials on its web site are accurate, complete, or current. Dirt Gypsy Adventures has not reviewed all of the sites linked to its Internet web site and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Dirt Gypsy Adventures of the site. Use of any such linked web site is at the user’s own risk.

 

7. Site Terms of Use Modifications

Dirt Gypsy Adventures may revise these terms of use for its web site at any time without notice. By using the web site you are agreeing to be bound by the then current version of these Terms and Conditions of Use.

 

8. Governing Law

Any claim relating to Dirt Gypsy Adventures’ web site shall be governed by the laws of the State of California without regard to its conflict of law provisions.
